Mary Kay Sues Yahoo! Over Alleged Trademark Infringement

The beauty giant alleges that the Web provider's email service inserts links and scroll-over pop-up ads to "unauthorized retailers in personal email messages that Mary Kay sellers send to their consumers."
According to the lawsuit, Mary Kay claims that this provides "'an unfair advantage for unauthorized re-sellers and other competitors," and that consumers may "mistakenly believe that the hyperlinks and pop-ups which include ads associated with Mary Kay marks were affirmatively included or authorized by either Mary Kay or the Independent Beauty Consultant sending the email,'" the source cites.
The cosmetics company is seeking an injunction as well as monetary damages.

Best of luck to them given the whole it's a free email service that has a TOS that all their sellers agreed to where section 2 notes that they'll be embedding ads and pretty much anything else they like because that's how they support the service. I'm sure corporate couldn't be bothered to check into that before filing and as a result they'll end up paying attorney fee's for Yahoo in like 9 months.
