American Eagle Outfitters Settles Transgender Discrimination Complaint

A transgender group has scored a major victory in a discrimination complaint against American Eagle Outfitters, the NY Daily News reports.

After community rights group Make the Road New York complained to New York Attorney General Andrew Cuomo's office about alleged job discrimination against transsexuals at the major retailer, Cuomo has demanded that the mall favorite adjust "personal appearance" policies that ban male employees from wearing women's clothing and vice versa, according to the paper.

American Eagle also reportedly agreed to a settlement deal that will require changes to its employee handbook and store policies.

"To avoid further expense and the distraction of a prolonged argument, [we have] agreed to a compromise settlement in this case, with the understanding that AEO is not admitting to the findings," a company spokesperson told the paper.

"We wholeheartedly believe that transgender individuals should be treated equally."

Heck, yeah!

Meanwhile, the transgender community is celebrating the victory (reportedly the first of its kind against a retailer under New York's Human Rights Law)... and, perhaps, eyeing a career in folding plaid button-downs?

"This shows me that there's faith and hope," Make the Road New York member Joi-elle White, who is transgendered, told the Daily News.

"There might be a domino effect, that's what I'm hoping for.

"If more places would follow behind American Eagle's experience, a lot of us would be able to work more. And there would be less of us on the street or on the Internet risking our life just to survive."

In March, the group protested against J.Crew over claims that the company discriminated against transgender job applicants, the Daily News reported.

I was a manager at AE for 5 years I had several men work there that wore womens clothes especially jeans... It was nice for the young boys coming in to try on girls jeans these guys would turn around and say I have these ones one and the boys would relax. They were always so nervous the first time they wanted to buy girls jeans...

What you do on your own time is your own damn buisiness. However when you work for someone dress accordingly, you're there to do a "job" not make a statement !!!!! McDonalds has a uniform, so does Hooters. American Eagle should go that route.

Goth,Vampire, Emo, Crossdressers, Completely tatted arms having trouble finding work? Maybe it's not how you look that's keeping you from landing that job, it's probably that chip you have on your shoulder against society.

Most people hate transgenders, they laugh at you, they're just being "PC" when they don't do it to your face.

If Joi-elle can't change clothes for 8 hours a day to keep a job and would raither be a freak show living on the streets then that is where she/he/it deserves to be. Come on people this is not the side show at the circus, I don't want some guy in a dress waiting on me when I go in to shop. Why is it that Americans don't stand up against this crap if your not gay or a drag queen you don't have any rights?????????

The first thing to remeber is there is nothing AMERICAN about American eagle . It is just another exporter of jobs by importing cheaply made clothes just like walmart,kmart macys and all those other greedy stores that stupid Americans standin line to support while complaining about losing our jobs and country .I say let them dress anyway they want for stop buying there until they start carrying at least 50% of their stock American made .

If I hired a fireman to work as a sales clerk I'd probably be ticked off if he showed up for work in his fireman's clothes. Same with many other professions. If these people were not hiring trangendered people because they identify with that then I would probably consider it wrong. If these employees violated my company dress code then I have no problem with them being terminated. As I understand it they want, and apparently got, the right to dress as they please while in my employ. That was wrong. I am assuming(yeah I know) that the employees are wearing street clothing for the gender choice they have made. What happens when they decide they want to wear extremely skimpy and inappropiate clothing? Or no clothing at all? Every choice made comes with some sort of consequence. This employer, rightly or wrongly, is going to lose employees and customers over this. Why jeopardize his livelihood?

I support equal employment opportunities for all races and people who are handicapped, so long as the disability doesn't interfere with them doing the work outlined in the job description. These are inherent differences people are born with and do not arbitrate a person's rights. However, transgender is a LIFESTYLE CHOICE. If you are a woman and want to wear a man's business suit, or you are a man and want to wear a wig & stilletto's, then you need to find a job in a place where that is allowed per company policy. I guaran-damn-tee you at my board meeting, there won't be any drag queens or shemales. Do what you like on YOUR time, but company time is MY time. I buy it when I pay your salary and you have to play by MY rules. Appropriate business attire according to company policy, or find yourself another job.

Andrew Cuomo made a bad decision when he demanded American Eagle Outfitters change its employee policy. At the same time, his decision punished AEO for a store policy which maintained brand image, which in this case is traditional American clothing, Making businesses cater to the lifestyle whims of potential employees has nothing to do with human rights, civil rights or equal treatment under the law. This was a political decision to garner the GLBT voting bloc for Cuomo, who is shacking up and fornicating on a regular basis with his lover, when he runs for Governor of NY.

First off, it's not fair for you to simplify what it means to be transgender by saying that they merely want the ability to dress up in clothes of the opposite sex. Not all transgenders fit into that category. There are many transgendered people that ultimately associates themselves as the opposite gender than what he or she biologically/physically (unless they are able to afford surgery) look like. Someone who identifies him or herself as a transgender did not necessarily choose to be that way. In some cases, transgendered people feel trapped inside a body that physically resembles the opposite sex. Before you make a blanket statement, do some more research and actually learn a bit more about from where Mr. Cuomo is coming.

The minority secs are taking over....stuff is really screwed up.
If the out of the norm minority doesnt like it...they can either change or shop somewhere else........GOOD GOD!!
Things are outta hand as far as personal self control and common sense!! Lokk at the kid who got tasered at the ball park. If the guy had a brain, he would know you just dont jump down on the ball field. You might pay the piper for stupid acts.

I agree that the legal system has lost it's way. A business should be able to insist that there be a "reasonable" dress code for employees. If a male wants to dress in female clothing, do it AFTER work! The NY AG is a policial hack!!
