The New York Times reports that the 24-year-old, son of Oscar-winning songwriter Joseph Brooks, was charged with second-degree attempted murder and second-degree strangulation on Friday evening.
Cachay was found dead in the bathtub inside a Soho House room on Thursday. Autopsy results have so far been inconclusive.
More details about the case did emerge over the weekend, according to the Times. At Brooks' arraignment, the prosecutor, Jordan Arnold, said: "He attempted to kill a young woman who had absolutely everything to live for. The injuries to her are significant and a classic hallmark of an attempt to kill." Cachay suffered from internal hemorraghing, broken blood vessels in the eyes and face, cuts on the lips and mouth and injuries to her scalp.
Brooks' attorney, Jeffrey C. Hoffman, maintains his client's innocence and insists that he has reason to believe others, including a concierge and member of the hotel's room service staff, had been in Cachay's room between the time that Cachay checked in and 2:49 a.m., when her body was discovered by hotel employees.
Brooks was not there at the time of the discovery, but returned back to the hotel at 3:30 a.m. Of his client's actions, Hoffman says: "It would be the rare person who believed they had harmed somebody - or worse, killed them - who would come back to the place where that person was if they believed such a thing had happened."
A "letter of apology" from Mr. Brooks to Ms. Cachay was also found, the details of which were not disclosed.
Tissue and toxicology tests are being carried out to determine the swimwear designer's cause of death.
